Nishant Joshi is a Partner in the Firm’s Dispute Resolution practice. His area of proficiency is an interesting mix of Dispute Resolution and General Corporate practice.
Special mention must also be made of his keen area of interest and specialisation – White Collar crimes and criminal trials. Nishant has been ranked and named in ‘The Legal 500’ as “a safe pair of hands to handle sensitive white-collar crime matters.” Chambers & Partners, 2020 quotes, “Nishant is acknowledged by market commentators as a “good practitioner” who “does a large amount of contentious and non-contentious work” in this field. According to Benchmark Litigation 2019, “He is one of the most approachable, accessible and knowledgeable lawyers when it comes to criminal law; especially white collar crimes.”
Nishant has extensively appeared in various Courts & Tribunals in India with regard to matters relating to frauds, cheating, misappropriation, breach of trust, money laundering, data theft, cyber-crimes, defamation and other economic offences. He has conducted trials of complex criminal cases both as counsel for the complainant/assisting Prosecution and counsel for accused. Additionally he has also handled cases under Negotiable Instruments act, Prevention of Money Laundering act, IT Act etc. and has also conducted internal investigations for various clients.
Nishant has also been the face of the Firm in matters involving interacting with officials in the Government and Government relations specifically with the Police, CBI, Interpol, FRRO, SFIO, Civic agencies and various Government Ministries both at State and Central level. He has worked along with Investigation teams of the Police in numerous criminal trials and assisted the Prosecution besides acting for defence counsel for various clients.
Nishant has also authored and co-authored articles and chapters in various publications on Anti-corruption/Anti-bribery laws in India and has conducted webinars and training sessions for several companies in relation to compliances under Indian law. He has also rendered opinions and detailed memorandums on queries relating to Anti-corruption laws, Anti-bribery laws, Cyber laws, Indian Penal Code and other penal statutes of India in addition to comparative analysis of penal laws of various other international jurisdictions and India.
Nishant’s extensive criminal law experience also gets an edge from Nishant’s previous transactional experience where he has worked on a number of corporate matters relating to Mergers & Acquisitions, Private equity investments, Real estate transactions etc. He also has reasonable experience on the civil litigation front and he has appeared and continues to appear in numerous Courts & Tribunals in India with regard to matters pertaining to property law disputes, contract law issues, IP disputes, Consumer disputes arbitrations, matters relating to recovery of moneys, injunctions, specific performance etc. in addition to appearing in many High Courts with regard to matters relating to reduction of capital, schemes of arrangements including mergers and de-mergers etc.
In addition to the aforesaid profile at the Firm, Nishant has the unique experience of acting as the Lead Counsel for a US Multinational (Motorola) in 2008-2010 (on secondment from the Firm). During his stint, he has been instrumental at taking care of entire legal operations – inter alia including litigation (which included defending the Directors against criminal liability, arbitrations, labour matters, consumer matters) and corporate-commercial matters (including telecom transactions, government and private tenders etc.) and compliance portfolio. Thereafter, Nishant also handled the legal operations of an affiliate company of a US Multinational Bank (Citi) for about 1 year on secondment and during the said stint, he handled the entire litigation portfolio for the client. He is also currently retained to handle and advise on all litigation matters (both Civil & Criminal) of a leading Korean multinational (Samsung Electronics) in the entire SWA region.
Nishant has been with the Firm for over 17 years. Overall he has an experience of about 22 years in the legal profession and has been an enrolled lawyer with Bar Council of Delhi since the last 19 years.
