On December 22, 2022, Law 28/2002, of December 21, for the promotion of the ecosystem of emerging companies (the “Startups Law”) was published in the BOE, the objective of which is to support the creation and growth of emerging companies in Spain.
This Flash focuses on analyzing the new regulation of those known as ” digital nomads ” introduced by the Startups Law.
- General considerations
A digital nomad will be considered a national of a third state, authorized to remain in Spain to carry out a remote work or professional activity for companies located outside the national territory, through the exclusive use of computer, telematic and telecommunication media and systems.
In the case of exercising a labor activity, the digital nomad may only work for companies located outside the national territory.
In the event of exercising a professional activity, the digital nomad will be allowed to work for a company located in Spain, as long as the percentage of said work does not exceed 20?% of the total of their professional activity.
