As of March 20 (2024), a company will be able to receive notifications of lawsuits filed against it (be summoned) by telematic means.

This is one more of the measures intended to streamline our judicial system, after the approval of RD 6/2023. This measure breaks with a traditionalism established in our system of judicial summonses (notifications), which required them to be carried out in person through officials of the Administration of Justice most of the time.

Starting today, March 20, placements can be made through telematic means such as the Single Enabled Electronic Address (DEHú), managed by the Central Government, or the equivalent systems of the different Autonomous Communities.

This change can bring unpleasant surprises for the administrator if he is not attentive, since he may be surprised with a declaration of rebellion if he does not review and correctly configure the “mailboxes” in which he is registered (or it is convenient for him to register). Nor can it be ruled out that situations of legal uncertainty may arise given the plurality of telematic options that currently exist.
