David Rein, Deputy Managing Partner of S&C’s Litigation Group, and Eric Andrews, a litigation associate, authored an article for Financier Worldwide, “Key Litigation Risks and Mitigation Strategies for non-US Companies Listed in the US.” The article identifies some of the most common sources of civil litigation for these companies and outlines some ways to mitigate these risks.

David and Eric note that, while the risk of becoming embroiled in US litigation can never be completely expunged, periodic and deliberative risk assessments can represent the most effective technique for identifying risks and implementing mitigants.
