Compliance with Prevention and Occupational Health Services for companies with between 5 and 50 employees

The General Inspectorate of Labor and Social Security (IGTSS), through its Environmental Working Conditions (CAT) division, announced the requirements that must be met by the documents to be submitted by companies with between 5 and 50 employees to accredit the implementation of the Health and Safety Services at Work before an eventual inspection.

We recall that for these companies the obligation to implement them has been in force since November 2022 and basically consists of the preparation of an Occupational Risk Prevention Plan by a Prevention Technician or equivalent title¹ (Decrees Nos. 127/014, 126/019, 277/020 and 52/023).

According to the CAT division, the Occupational Risk Prevention Plan must have the following content²:

  • Description of the activities of the company.
  • Hazard identification.
  • Results of the risk assessment by recognised and specific methods. It is important that prior to the evaluation the degree of compliance with the specific regulations that apply to the activity of the company must be known.
  • Corrective measures.
  • Compliance schedule.
  • Date of preparation of the Plan and date of next revision. The Plan should be reviewed at least every 6 months.
  • It must be reliably indicated by the responsible technician whether or not he recommends the need to have a Prevention and Health Service at Work, that is, the hiring of a Medical Specialist in Occupational Health and Preventive Technician or similar title.
  • Signature and identification data of the Prevention Technician or equivalent title, responsible for the document.
  • Validation signature of the owner or legal representative of the company.
