Patent protection experts parade from the celebrations for the assignment in Milan of a branch office of the European Patent Court , which had to leave its London office after Brexit. At the European level in recent days an agreement was reached on Italian requests , which opposed those of France and Germany for the offices in Paris and Munich . But now the crux is on the responsibilities of this office assigned in the Lombard capital.

The jurist Galli: Missed opportunity 

«Minimum residual skills, of no economic significance, have been assigned», comments with MF-Milano Finanza Cesare Galli , professor of industrial law and lawyer, one of the leading Italian experts in the field of industrial property protection. “And it hasn’t even been possible for the headquarters in Milan to leave on June 1st together with those in Munich and Paris”.

«The competences of London have been divided up – continues Galli – and, in a year’s time, they will leave us few crumbs: only patents classified as pharmaceuticals that do not have the additional protection of the SPC (i.e. the extension of pharmaceutical patents), which is practically to all those who have led to a drug being sold on the market. In practice, they leave us the worthless ones: and not even all of them, because if they are classified as chemists, which happens half the time, they go to Munich».
