The environmental dispute resolution department of Pellerano Nadal Law and Consulting, led by Gustavo Mena García, and comprised by B. Génesis Rodríguez González, Sekira Hernández Díaz and Carlos Matos Fernández, represented the interests of the company GENERADORA ELÉCTRICA DE SAMANÁ, S.A. (GES), in the amparo action filed by the Instituto de Abogados para la Protección del Medio Ambiente (INSAPROMA) and others, before the Civil, Commercial and Labor Chamber of the Court of First Instance of the Judicial District of Samaná.
The amparo action sought to prevent the relocation of GES’s energy production equipment, which is currently located in the urban area of the community of Las Galeras, Samaná.
The aforementioned team successfully defended the case, obtaining that the aforementioned amparo action, by means of Decision No. 540-2023-SSEN-00563 dated December 8, 2023, was declared inadmissible for being manifestly inadmissible, as was invoked by the team, in accordance with numeral 3 of article 70 of Law 137-11 of the Constitutional Court and Constitutional Proceedings.
