On February 22, 2023, the Cyberspace Administration of China officially issued the “Standard Contract Measures for the Transfer of Personal Information Abroad” (hereinafter referred to as the “Standard Contract Measures”), which will come into effect on June 1, 2023. According to relevant legal provisions, for security assessment, which is also one of the legal paths for data export, the legal specification “Data Export Security Assessment Measures” has been implemented on September 1, 2022. On the eve of the implementation of this measure, the Cyberspace Administration of China (“Cyberspace Administration of China”) released the “Guidelines for Declaration of Data Transfer Security Assessment (First Edition)”. This time, before the official implementation of the “Standard Contract Measures”, the Cyberspace Administration of China also released the “Recording Guidelines for Standard Contracts for the Transfer of Personal Information (First Edition)” (hereinafter referred to as the “Recording Guidelines”) on May 30, 2023. ) to “guide and assist personal information processors in standardizing and orderly filing standard contracts for the transfer of personal information abroad.”
