REGULATORY GUIDE TO ACQUIRE AN ESTABLISHMENT ALREADY IN OPERATION: IDENTIFICATION AND TRANSFER OF PERMITS

To acquire and maintain a commercial, industrial or service establishment in operation, the transfer of permits, licenses and other regulatory requirements must be managed before various public institutions. In order to avoid delays in the start of operations and even potential sanctions, it must be identified which permits the establishment has and in what order they must be transferred.

In the usual scenario, Company A wishes to acquire the establishment of Company B. At this time, all permits are in the name of Company B, which must be transferred to Company A for it to assume operations.

The common thing is that the establishment has at least the following two permits: the sanitary operating permit (PSF), issued by the corresponding Health Governing Area Directorate (DARS) of the Ministry of Health and the commercial patent, issued by the local Municipality .

At this point, it should be clarified that the commercial patent depends on the PSF, with which the change of permit holder of the PSF must first be processed.
