Why All Eyes Are On Florida’s Affordable Housing Reform

In an article published on August 4 in Law360, David Leon, Hollie Croft, and Nick Heckman discuss Florida’s Live Local Act and how developers across the country are discussing the act’s zoning preemption provisions and its missing-middle property tax exemption.

“The new statutory provisions allow multifamily developers to develop projects on land that is currently zoned as commercial, industrial or mixed use without the need for comprehensive plan amendments or rezonings. Further, the act provides a property tax exemption to developers satisfying the missing middle exemption’s requirements, which such rent and income restrictions are generally not far from the typical developer’s natural tenant base it serves,” said Leon, Croft, and Heckman. “More and more developers across the nation are expressing their interest in the act or actively seeking to develop projects in accordance with it. We can only hope that this act is the first of many more laws to come in Florida that promote much-needed affordable and workforce developments.”
